DS Nexus — Terms of Service

These Terms of Service ("Terms") govern your use of DS Nexus, an app and related services provided by Custos Forge, LLC ("Custos Forge," "we," "us"). By creating an account or using DS Nexus, you agree to these Terms. If you don't agree, please don't use the app.

DS Nexus is currently in a limited pilot with a small number of invited contractors. Some of what's below reflects that stage and will be updated as the product moves toward general availability.

1. What DS Nexus is

DS Nexus is a voice-first business tool for contractors. It lets you manage customers, jobs, estimates, invoices, notes, expenses, and payments by speaking to the app instead of typing. DS Nexus is a tool you use to run your own business — Custos Forge is not a party to, and takes no responsibility for, the work you perform or the agreements you make with your own customers.

4. Payments

When you send an invoice through DS Nexus and a customer pays it, that payment is processed by Stripe. Card details are handled directly by Stripe under Stripe's own terms — Custos Forge never sees or stores card numbers. You're responsible for the prices, taxes, and terms you set for your own customers; DS Nexus is the tool you use to bill and collect, not a party to that sale.

During the pilot, DS Nexus itself is provided at no charge. If and when paid plans are introduced, we'll tell you before anything changes for your account.

5. Your data and content

You own the business data you put into DS Nexus — your customers, jobs, estimates, notes, and photos. We store and process it so the app can work, as described in our Privacy Policy. We don't sell it, and we don't use it to train models sold to anyone else.

6. Intellectual property

DS Nexus — the app, its design, and the software behind it — belongs to Custos Forge, LLC. These Terms don't grant you any ownership in DS Nexus itself; they grant you a license to use it to run your own business, for as long as your account is active and in good standing.

7. Service availability

DS Nexus is in active development and, during the pilot especially, may have downtime, bugs, or features that change or are removed. We'll do our best to keep the voice pipeline, scheduling, and billing features working reliably, but we can't guarantee uninterrupted availability.

8. Disclaimer and limitation of liability

DS Nexus is provided "as is," without warranties of any kind, express or implied. To the fullest extent the law allows, Custos Forge, LLC is not liable for indirect, incidental, or consequential damages arising from your use of the app — including lost business, lost data, or a missed job — beyond the amount you've paid us in the twelve months before the claim (which, during the free pilot, is zero). Nothing here limits liability where the law doesn't allow it to be limited.

9. Termination

You can stop using DS Nexus and ask us to delete your account at any time by emailing support@custosforge.com. We may suspend or terminate an account that violates these Terms, or, during the pilot, that's no longer part of the invited group.

10. Changes to these Terms

As DS Nexus moves from pilot to general availability, these Terms will be updated to reflect new features and, if applicable, paid plans. We'll update the date at the top of this page when that happens, and we'll make a reasonable effort to notify active users of material changes.

11. Governing law

These Terms are governed by the laws of the State of Mississippi, without regard to conflict-of-law principles.
